Florida homeowners may protect property value via legal action

For many people, real estate is the most expensive thing that they will purchase. Because this is such a large investment for most it makes sense that property owners would do what they can to make sure that actions are not taken that would make the real estate value decline. In some instances this could involve taking legal action.

Residents of a wealthy enclave in a Florida community recently opted to take this course of action. The two homeowners are a part of a lawsuit against the U.S. Department of Transportation.

The dispute involves funding that is being supplied to All Aboard Florida. The homeowners believe that their homes which, despite being located near train tracks, are valued at more than $1 million will be negatively impacted by the expansion of the express passenger rail project. They are afraid it will impact both their safety as well as their quality of life.

More specifically, one of the homeowners, who has access to the Intracoastal Waterway via a dock on the property, believes that more train traffic would make it harder to run boats on the river. In addition, that property owner asserts that the following would result from an expansion of the rail project:

• Greater noise
• Damage to environmental resources
• Harm to county parks in the area
• Damage to neighborhoods

How this case will be resolved remains to be see. Nonetheless it is easy to see why a homeowner would want to protect the value of his or her property. Individuals who find themselves in this position would benefit from working with a lawyer who handles property disputes.
