Non-Compete Agreements Under Scrutiny

States take vastly different approaches to non-compete agreements . This article explores the different public policy arguments relating to non-compete agreements. Idaho has taken a very different approach than California.  Non-conmpete agreements are void in California while Idaho's new law strengthens the enforcement of non-compete agreements. In Florida, non-compete agreements are sometimes enforceable and other times are not enforceable depending on several factors. If you have any questions or would like legal advice on whether your Florida non-compete agreement is enforceable, please contact Carr Law Firm, P.A.

Contract disputes may be more likely with oral agreements

A handshake used to make an honorable agreement between two people doing business. Unfortunately, when people rely on a handshake, they may end up in contract disputes that lead to litigation. For one couple in Florida, such a dispute took a bizarre turn when the contractor they hired to renovate their home failed to provide what he promised.

Does your contract have an arbitration clause?

Contracts of any kind are often long, specific and full of legalese. Because of this, many people may not always grasp every element of the agreement. This is not uncommon, but if you sign something without understanding it and without getting an explanation from your attorney, you could wind up agreeing to some unfavorable terms.

What are 'handshake agreements,' and are they binding?

If you are a baseball fan in Florida, you are likely aware that the Miami Marlins have had a challenging past few years, and it may not surprise anyone to learn that owner Jeffrey Loria is looking to sell the team. In fact, sources report that Loria has a "handshake agreement" with someone looking to buy the team for $1.6 million.

The do's and don'ts of entering into a contractual agreement

Contracts are legally binding agreements between two or more parties that are enforceable by the law. Some business contracts might be simple enough such as a purchase order or a verbal agreement while others may be more complicated, involving much higher stakes. Entering into a contractual agreement with another party is serious business, and you must never rush yourself into signing a business contract no matter how trustworthy the other party may seem.

Types of intellectual property rights

Intellectual property refers to intangible assets that are the creation of the human mind such as inventions, literary or artistic works. These assets are protected by law, giving exclusive rights to the owner. Common types of intellectual property rights which you can use to protect your business and creations include copyrights, trademarks and patents.

Dealing with a contract breach

A contract is a written, formal agreement that is enforceable by law. Contracts are a common concept in the business world. Contracts are highly useful and are made to benefit all parties involved. In some cases, problems might arise that could lead to contract disputes. A business contract consists of certain rules and obligations that must be complied with by all parties involved. If any party fails to follow the rules set by the contract, then this is formally known as a contract breach.
