The five commandments of property management

As a landlord, you're proud to offer your commercial tenants a beautiful space to help them thrive. After all, if they thrive, you thrive. Most of the time, landlords and tenants enjoy a mutually beneficial relationship and everything runs relatively well. Unfortunately, disputes do arise and, if they're not handled properly, they can mean everything from financial setbacks to complete disaster.

 

With that in mind, here are some crucial commandments to follow to keep disputes from happening:

  • Thou shalt not discriminate. The Federal Fair Housing Acts prohibits landlords from discriminating against a tenant (or potential tenant) based on sex, race, disability or national origin.
  • Thou shalt always put thing in writing. The commercial lease agreement should spell everything out in detail and any further communication should always be in writing in case a "he said, she said" argument starts.
  • Thou shalt always notify. Unless it's an emergency, you need to notify the tenant that you'll be entering the property. This should be done in writing and at least 24 hours prior.
  • Thou shalt maintain safety. Unsafe or dangerous conditions could be disastrous for you as a landlord, so inspecting your property regularly and fixing any potential hazards will go a long way. In this case, an ounce of prevention can save you a pound of trouble.
  • Thou shalt make repairs. If your agreement says you will make repairs, you must comply with it or your tenant may be able to withhold rent or even sue.

Even following these commandments, you may find yourself in a dispute with a tenant. If that happens, an attorney may be able to help you get it resolved.
