An introduction to construction defects

When you contract someone to build a home or commercial property, you expect it to be constructed to certain standards. When those standards aren't met, what recourse do you have to make things right?

 

Before we answer that, let's take a look at some of the things that could be considered a construction defect:

  • Substandard materials. The materials that go into a home or commercial property can make all the difference. If the contractor chooses below average materials or the manufacturer didn't make the materials up to code, it can cause expensive problems down the road.
  • Poor design. Before the foundation is poured, the construction project needs a good plan. This requires engineers and architects. If they fail to properly lay out the design, the entire structure could be at risk.
  • Construction problems. Even if the plan is well laid out and the materials are up to snuff, the workers who build the property might cut corners or do a poor job. For instance, a construction worker could fail to properly seal some part of the structure, allowing moisture in and creating a mold problem.
  • Bad foundation. A strong building starts with a good foundation. If that's missing from the equation, a simple flood, erosion or a shift in the subsurface could result in cracks.
